Welcome to Kar-Gah! These Terms and Conditions govern your use of our website www.kar-gah.com and the purchase of any products from Kar-Gah. By accessing the Site or placing an order, you agree to be bound by these Terms. Please read them carefully.

1. Acceptance of Terms:

By accessing or using the Site, you acknowledge that you have read, understood, and agree to be bound by these Terms, and all other policies posted on our Site. If you do not agree to these Terms, please do not use the Site.  

2. Use of the Site:

  • You may use the Site for lawful purposes only. You are prohibited from using the Site in any way that could damage, disable, overburden, or impair the Site or interfere with any other party's use and enjoyment of the Site.  
  • You agree not to attempt to gain unauthorized access to any part of the Site, accounts, computer systems, or networks connected to the Site.  

3. Product Information:

  • We strive to provide accurate and up-to-date information about our Products, including descriptions, images, and pricing. However, we do not warrant that the descriptions, images, pricing, or other content on the Site are error-free, complete, reliable, current, or accurate.  
  • Colors of Products may appear differently on your screen depending on your monitor settings. We do not guarantee that your monitor's display accurately reflects the actual color of the Product.
  • All Products are subject to availability, and we reserve the right to limit the quantities of any Products that we offer.  

4. Pricing and Payment:

  • All prices displayed on the Site are in Pakistani Rupees (PKR) unless otherwise stated.
  • Prices are subject to change without notice. The price you will be charged is the price displayed on the Site at the time you place your order.
  • You agree to pay the full price for the Products you purchase, including all applicable taxes and shipping charges.
  • We accept the payment methods listed on our Site. By submitting your payment information, you represent and warrant that you are authorized to use the designated payment method and that you authorize us (or our third-party payment processor) to charge your payment method for the total amount of your order.  
  • For Cash on Delivery (COD) orders, you agree to pay the total order amount (including any applicable delivery charges and COD fees) in cash to the delivery agent upon receiving your order.

5. Order Placement and Acceptance:

  • Your order constitutes an offer to purchase the Products listed in your order.
  • All orders are subject to acceptance by Kar-Gah. We may, at our discretion, refuse to accept your order for any reason, including but not limited to:
    • Product unavailability.
    • Errors in pricing or product information.
    • Suspicion of fraudulent activity.  
    • Shipping restrictions.
  • If we are unable to accept your order, we will notify you and will not charge you for the Product or will issue a refund if you have already paid.
  • A confirmation email/ Message will be sent to you upon our acceptance of your order. This email will contain your order details and tracking information (once available). The contract for the sale of Products is formed when we send you the shipping confirmation email/ Message.

6. Shipping and Delivery:

  • Our shipping and delivery procedures are outlined in our Delivery Policy, which is incorporated into these Terms by reference. Please refer to the Delivery Policy for information on shipping options, delivery timeframes, and charges.

7. Returns, Exchanges, and Warranty:

8. Intellectual Property:

  • All content on the Site, including but not limited to text, images, logos, designs, graphics, audio clips, video clips, data compilations, and software, is the property of Kar-Gah or its licensors and is protected by copyright, trademark, and other intellectual property laws.
  • You may not reproduce, distribute, modify, display, perform, publish, license, create derivative works from, transfer, or sell any content obtained from the Site without the prior written consent of Kar-Gah.  
  • Kar-Gah trademarks, service marks, and logos (the "Marks") displayed on the Site are the property of Kar-Gah. You are prohibited from using the Marks without our prior written consent.

9. User Content:

  • If you submit any content to the Site (e.g., reviews, comments, feedback), you grant Kar-Gah a non-exclusive, royalty-free, perpetual, irrevocable, and fully sub-licensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media.
  • You represent and warrant that you own or otherwise control all of the rights to the content you submit and that the content is accurate, not misleading, and does not violate these Terms or the rights of any third party.  

10. Links to Third-Party Websites:

  • The Site may contain links to third-party websites that are not owned or controlled by Kar-Gah. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites.
  • You acknowledge and agree that Kar-Gah shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any content, goods, or services available on or through any third-party websites.

11. Disclaimer of Warranties:

  • THE SITE AND ALL CONTENT, PRODUCTS, AND SERVICES MADE AVAILABLE THROUGH THE SITE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.  
  • KAR-GAH DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SITE OR THE SERVERS THAT MAKE THE SITE AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
  • TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, KAR-GAH DISCLAIMS ALL LIABILITY FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN ANY WAY CONNECTED WITH YOUR USE OF THE SITE OR THE PURCHASE OF PRODUCTS.  

12. Limitation of Liability:

  • TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL LIABILITY OF KAR-GAH FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS, THE SITE, OR THE PRODUCTS SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO KAR-GAH FOR THE APPLICABLE PRODUCTS.

13. Indemnification:

  • You agree to indemnify, defend, and hold harmless Kar-Gah, its affiliates, officers, directors, employees, agents, licensors, and suppliers from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your breach of these Terms or your use of the Site.  

14. Governing Law and Dispute Resolution:

  • These Terms and your relationship with Kar-Gah shall be governed by and construed in accordance with the laws of the Islamic Republic of Pakistan, without regard to its conflict of law provisions.  
  • Any dispute arising out of or relating to these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the courts located in Islamabad, Pakistan.  

15. Modifications to the Terms:

  • Kar-Gah reserves the right to modify these Terms at any time without prior notice. Any changes to these Terms will be effective immediately upon posting on the Site. Your continued use of the Site or placement of orders after the posting of revised Terms constitutes your acceptance of the changes. We encourage you to review these Terms periodically.  

16. Severability:

  • If any provision of these Terms is held to be invalid, illegal, or unenforceable for any reason, such provision shall be reformed only to the extent necessary to make it enforceable, and the remaining provisions of these Terms shall continue in full force and effect.  

17. Entire Agreement:

  • These Terms, together with our Privacy Policy and any other policies posted on our Site, constitute the entire agreement between you and Kar-Gah with respect to your use of the Site and the purchase of Products and supersede all prior or contemporaneous communications and proposals, whether oral or written.
